Is It Legal To Have Security At My Business?

Yes, BUT there are a few laws in Texas that you must be compliant with...

1702.102. (SECURITY SERVICES CONTRACTOR LICENSE REQUIRED) states that you need to hold a license as a Security Services Contractor to employ Security Officers. When you hire a security team for your business (private business or otherwise) you are acting as a guard company. Without a SSC License this is a violation and makes your business non-compliant.


There are lawyers all over the State of Texas that ACTIVELY pursue lawsuits against businesses, that are not in compliance, who's security personnel perform duties that require proper licensing. Such as removing someone from the premises.    

There are a few employees that would be considered Security Officers regardless of their job title:

  • Managers
  • Floormen
  • Event Staff
  • ID Checkers 
  • Doormen
  • Bouncers 
  • "Security" Staff

...or anyone else that performs security duties.

These duties include:

  • prevent entry, larceny, vandalism, abuse, fire, or trespass on private property
  • prevent, observe, or detect unauthorized activity on private property
  • control, regulate, or direct the movement of the public, whether by vehicle or otherwise
  • protect an individual from bodily harm including through the use of a personal protection officer; or
  • perform a function similar to a function listed in this section.

Penalties

It only takes one incident for a lawsuit to be filed against you.

  

Potential lawsuits from patrons aren’t your only risks. Not just for you, but for your security as well. A violation is a Class A Misdemeanor for the first offence and if convicted again it will be a Felony.


The penalty is $10,000 dollars per violation. Each day the violation is not in compliance, it is a separate violation for the purpose of imposing penalties. This can compound very quickly especially if you are not in compliance of multiple violations at once.
